Terms of Service

1. Agreement

By accessing or using EDGcast ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated into these terms by reference. If you do not agree to these terms, do not use the Service. We may update these terms at any time by posting the revised version on this page. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

EDGcast is a sports analytics platform that provides statistical analysis, team rankings, player ratings, matchup breakdowns, and model-generated predictions for various sports. The Service is available through our website and may include both free and paid subscription tiers.

3. Not Gambling Advice

EDGcast provides sports analytics and statistical analysis for informational and entertainment purposes only. Nothing on this platform constitutes gambling advice, financial advice, or a recommendation to place any wager.

All predictions, model leans, edge scores, and similar outputs are statistical estimates based on historical data and mathematical models. They represent a best guess, not a guaranteed outcome. Past model performance does not guarantee future results. Patterns that have been profitable historically may stop working at any time. Markets change, variance is real, and no model can consistently predict the outcome of sporting events with certainty.

You acknowledge that sports wagering involves substantial risk of loss. EDGcast does not encourage, facilitate, or promote gambling. If you choose to wager on sporting events, you do so entirely at your own risk and discretion. You should never wager more than you can afford to lose.

EDGcast is not a licensed sportsbook, gambling operator, or financial advisor. We do not accept wagers, process bets, or hold funds on behalf of users. We are not responsible for any losses incurred from the use of information provided on this platform.

4. Eligibility and Jurisdictional Use

You must be at least 18 years old to use the Service. By using EDGcast, you represent that you meet this requirement.

EDGcast is intended for use in jurisdictions where access to sports analytics platforms is permitted. You are solely responsible for ensuring that your access to and use of the Service complies with all laws applicable to you, including any local, state, federal, or international regulations governing sports information or paid handicapping services.

We reserve the right to restrict or refuse access to the Service in any jurisdiction at our sole discretion, without notice. Some jurisdictions require registration or licensure for paid sports information services; if you reside in such a jurisdiction, the burden of compliance rests with you.

5. Accounts and Subscriptions

Some features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan).

Payments are processed by a third-party payment provider. We do not store your full payment card details on our servers. Our collection and use of personal information in connection with the Service is described in our Privacy Policy.

You may cancel your subscription at any time. Monthly subscriptions cancel immediately at the end of the current billing period. Annual subscriptions remain active through the end of the paid term. No refunds are provided for partial billing periods.

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree not to:

• Scrape, crawl, or systematically extract data from the Service using automated tools
• Redistribute, resell, or republish EDGcast content, predictions, or analysis without written permission
• Share your account credentials or subscription access with others
• Use the Service to build a competing product or service
• Interfere with or disrupt the operation of the Service
• Misrepresent EDGcast content as your own analysis or research

7. Intellectual Property

All content on EDGcast, including but not limited to predictions, rankings, ratings, analysis, visualizations, software, and design, is the property of EDGcast and is protected by applicable intellectual property laws. Your subscription grants you a personal, non-transferable, non-exclusive license to access and view this content for your own personal, non-commercial use.

8. Copyright and DMCA Notices

EDGcast respects the intellectual property rights of others and expects users to do the same. If you believe that content on the Service infringes a copyright you own or control, you may submit a written notice to our designated agent that includes:

• A physical or electronic signature of the copyright owner or an authorized representative
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and information sufficient to locate it on the Service
• Your contact information (name, address, phone, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Notices may be sent through our contact page. We may remove or disable access to allegedly infringing material in accordance with the Digital Millennium Copyright Act and may terminate the accounts of repeat infringers.

Counter-notices may be submitted through the same channel and must include the elements required by 17 U.S.C. § 512(g)(3).

9. Accuracy and Availability

We strive to provide accurate and up-to-date information, but we make no warranties regarding the accuracy, completeness, or reliability of any content on the Service. Statistical models are inherently imperfect. Data sources may contain errors. Results may be delayed.

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access and may modify, suspend, or discontinue any part of the Service at any time without notice.

10. Limitation of Liability

To the fullest extent permitted by law, EDGcast and its team members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or use, arising from or relating to your use of the Service, whether based in contract, tort, negligence, strict liability, or any other legal theory. This includes, without limitation, any financial losses from wagering or other decisions made using information from the Service.

Our total cumulative liability for any claim related to the Service shall not exceed the amount you paid for your subscription in the twelve months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law, and the remaining provisions of these terms remain in full effect.

11. Indemnification

You agree to indemnify and hold harmless EDGcast and its team members from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these terms, or any wagering or financial decisions you make based on information from the Service.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these terms. Upon termination, your right to access the Service ceases immediately.

13. Governing Law and Venue

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of laws provisions. Subject to the arbitration provisions in Section 14, you irrevocably consent to the exclusive venue of the state and federal courts located in Travis County, Texas, for any disputes not subject to arbitration, and you consent to the personal jurisdiction of such courts.

If you access the Service from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

14. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH EDGCAST AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.

14.1 Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Service, or your relationship with EDGcast (each, a "Dispute") shall be resolved through binding individual arbitration, except that (a) you or EDGcast may bring qualifying claims in small claims court, and (b) either party may seek injunctive relief in court for actual or threatened infringement, misappropriation, or violation of intellectual property rights.

14.2 Arbitration Rules

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The AAA Rules are available at www.adr.org. The arbitration shall be conducted by a single arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver

YOU AND EDGCAST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of class or representative proceeding. If this Class Action Waiver is found to be unenforceable, then the entirety of this Section 14 shall be null and void, but the remainder of these Terms shall remain in effect.

14.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice through our contact page with the subject line Arbitration Opt-Out within 30 days of first accepting these Terms. Your notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

14.5 Survival

This Section 14 shall survive any termination of your subscription or these Terms.
